    New Delhi: A high-level panel is working on a way to control Saradha-like illegal investment schemes. The plan will be presented to the government in coming 15 days.

    “The roadmap consists of an active role of an existing  regulatory body to play a pro-vital role to prevent unethical aspects taking the gullible public for a ride,” a leading government source informed.

    The inter-ministerial panel headed by the added secretary (division of financial services), which fulfilled on Friday, is also actively considering the inclusion of quasi-judicial powers to the RBI and SEBI.

    The Centre’s job has actually become imperative after reported inaction on the part of government departments to act against such fraud schemes despite lots of cautions and alerts being sent out by the the Intelligence Bureau, Income-Tax department and Financial Intelligence Unit (FIU) among others.

    “Among the primary reasons for the insufficient state response was absence of MLM laws. The roadmap will also present to the government, the different ways to and means to close the spaces in the regulatory structure,” the official included.

    Our Take: We have been hearing about such meetings from past three years. These meeting mainly have had happened between RBI, SEBI, Ministry Of Corporate Affairs and Finance Ministry, till date we have not heard about the conclusions of such meetings. In the past IDSA, MoneyLife, FICCI and many other organizations have approached central governments many times to define the laws for MLM companies in India. But central governments in not in hurry. Maybe this time, we see something at the end of this meeting.

    Don’t think small

    The first thing is to not think of yourself as a ‘small’ business or you will market yourself as ‘small’ business. If you define yourself as small then you will represent yourself as small & ultimately be perceived as small. It is about projecting the image that you want people to have of your business & cultivating a vision.

    Also; small is just a question of perspective &, to prove it, let’s look at some statistics: The 2.7 million ‘small’ businesses that currently operate in Australia pay 60% of the nation’s work force & make up 30% of Australia’s GDP (gross domestic product). Small businesses are BIG business!

     

    Try different mediums & go with what works

    Today’s busy media world presents lots of opportunities to get your message out there. It’s definitely wise to take a ‘360 degree approach’ to your marketing – try everything you can & then disregard what isn’t working & focus your efforts on what is.

    There is no such thing as a ‘bad medium.’ Some mediums will be more appropriate to you than others in reaching out to your target audience – don’t make too many assumptions but judge the results instead.

    You may want to use different mediums together as part of an overall strategy. Some mediums may be great for building brand awareness & others better for making sales. For example; social media is great for reaching out to large audiences but not so good at making intimate, human connections. It may be that you may generate a great deal of brand awareness through social media but make more actual sales with referrals via business cards.

    Try it, measure it, pursue it.

    Learn the conventions

    The trouble with creating your own marketing material is that we are not all graphic designers. There are, however plenty of things that you can learn by just looking around at some of the conventions used in the media that we are surrounded by. Here are some examples:

    – Layouts. (This is how the elements are composed on a screen or a page.) Look at some layout conventions used in adverts that you may like & may be appropriate to your business.

    – Text: There are generally 3 types of a text in an advert; headline, sub headline & body copy. The headline should be very brief & feature your business ‘key-words’ (consider it in SEO terms). The sub headline will be smaller in text size & will elaborate on & clarify the headline. The body copy is the smaller text that the main body of text is written in. Look at the conventions employed, considering the column widths & the text size etc.

    All 3 of these text types use different font styles. Often the same font style will be used with different derivatives for each purpose (this is called a font family). Look at fonts you like & are appropriate to your market. You will find that there are fonts that are designed for headline use & others for body copy use &, when used correctly, these can look great (& terrible if used incorrectly).

    Execution: When creating graphics for web use, they will need optimizing for this purpose & saved at 72 dpi. Print graphics need to be high-resolution (300 dpi) & the paper you use can really affect the end product. You’ll be amazed at the great results you can achieve with high-res graphics, a decent home printer & good quality (90gsm) paper – plus you can print what you want, when you want & even print stickers by using adhesive paper.

    Use emotive imagery that tells a story

    We all know the one about a ‘picture is worth a thousand words’. It’s true – & never more so than in today’s fast paced media landscape. Your marketing message needs to be clearly conveyed as quickly as possible & images really help to achieve this.

    Interestingly, research shows that women respond to imagery in advertising much more than men.  Women engage better with human faces & emotive images that have a narrative appeal.

    Are your customers women or men? Well, research also shows us that, regardless of product, over 80% of ALL consumer purchase decisions are being made by women. This not only tells us that women are a hugely important market, it also tells us that they are buying on behalf of others, & so by understanding how to market your products to women you are also capturing men & children by focusing on the decision maker.

    Be smart with your budget
    All businesses, large & small, have a marketing budget & the real trick is to be as wise as possible with this budget. For example; if you are spending all of your money on one large billboard in one spot then you may get a high-penetration rate with the people that are seeing it daily but you will be limiting your audience as it is not mobile. On a smaller scale; if you are spending your entire budget on a glossy brochure then, again, you will be limiting your potential audience to those that can borrow your glossy brochure.

    In order to give your business the maximum exposure you need promotional material available in volume. You want maximum quantities with a minimum unit cost, so creating your own is perfect for this.

    Consistency, consistency, consistency

    The most damage you can do to your business image is to be inconsistent with it. This is so detrimental to your credibility & so often comes about because people say; ‘right I’ll get business cards done first & then some flyers later, when I have some money to reinvest’. Later never comes in this scenario &, if it does, then the flyers are either sourced from elsewhere or created differently & simply make the business look small & unprofessional.

    Start as you mean to go on with a consistent, professional image throughout your entire marketing inventory – on day one. Also, remember that marketing your business is not a ‘nice to have’. It is essential. Being in business without marketing is like being in the water without paddling. When asked what he would spend his last dollar on, Bill Gates famously replied “I’d spend it on marketing.”

    AMWAY India who is dealing with a case in Kerala, where lot of outlets closed, got a relief on Friday when the Kozhikode district court gave orders to unseal its warehouses and offices in Ernakulam, Thrissur, Kozhikode and Kannur. The relief came when AMWAY gave a bank warranty of Rs 1 crore.

    The chief judicial magistrate court, Kozhikode, had earlier disregarded an application for the very same on March 25. The company submitted a modification request at the area court on April 24 stating the goods secured are disposable and that because of search, seizure and office closing, the local business at these regions had come to a dead stop.

    The economic offences Crime Division, Kozhikode, searched the offices and godowns of Amway in the four areas on November 9 in 2012. Sealing them the exact same day and a case was registered against the directors of the firm under Prize Chits and Money Circulation Schemes (banning) Act after obtaining a grievance from Vishalakshy, a local of Kunnamangalam in Kozhikode, that alleged dishonest by the firm. Amway India’s Chief Executive Officer William Scott Pinckney and two of his directors were detained by the Criminal offense Division on May 27 and permit off on bail the next day.

    Vishalakshy, in her grievance, alleged that from September 2010 onwards, two persons, Ashokan and Firoz, generated her to sign up with multi level marketing company, Amway and on different times collected Rs 2.5 lakh and also yet another Rs. 50,000 for taking an insurance plan. However she could not sell the Amway products and the money was not returned.

    It’s not the first time when lot of Indians will lose their hard-earned money.  All MLM scams come in disguise but the modus-operandi has all been to loot gullible people. Infamous MLM companies like SpeakAsia, MMMIndia.in, Nmart, Gold Sukh, Fine India, All Hit Deals and lot more are not only looting people but they are also destroying the basic fabric of MLM in India.

    The only difference is that at the end of these short-lived ponzi scams, all that is left are Speakasians, Mavrodians etc. Who hope to get justice someday from Indian courts but here judgement takes long due course of time. All they can do is to wait with a faith to get their money back someday.

    It’s not their fault for being always super charged as Speakasians and Mavrodians. Without much knowledge about MLM business, even if they end-up making small fortune out of these short-lived ponzi schemes, they feel respected and elevated. And they have every right to feel so.

    The real fault lies with governments , who are not passing strict and strong laws to protect her citizens against fraudulent ponzi MLM schemes in India.

    Every time a big scam is unearthed, all we get to hear is that soon some strong mlm law is on the way to end this nonsense menace for all time.

    After that few meeting are held among RBI, SEBI, MCA and Finance Ministry but nothing has materialised till date.

    The need of time is to get strong MLM law in India and MLM people must join in to make this happen at the earliest.

    Sify CEO Kamal Nath Receives Warrant In Amway Fraud Case

    The Economic Offences Wing of the Kozhikode Crime Branch has charged Kamal Nath, CEO of Sify Technologies, as an accused in the Amway multilevel marketing fraud case for continuing to provide its services to Amway in spite of receiving a warning letter from the Crime Branch three months ago, reports New Indian Express.

    The report also states that the Crime Branch had pointed out in its warning letter that Amway has engaged in money chain business and so Sify should stop its services to the company. However, in its reply Sify had stated that they were only engaged in a bone fide business with Amway. On these grounds, a warrant has been issued against Nath by the Chief Judicial Magistrate Court in Kozhikode on being charged under section 109 (abetment) of the Indian Penal Code and also being listed as the 14th accused in the Amway case.

    Originally, a case against Amway was filed based on a complaint received from Vishalakshi of Chathamangalam.

    Another Case of Intermediary Liability?

    It appears to be a case of intermediary liability as the report states that Sify continued providing its services on the basis of  bona fide agreement with Amway. However, since the Crime Branch had provided them with a warning 3 months prior to the issue of the warrant, the company is being held responsible. It seems that the technology company is being taken to task due to their client’s wrong doings. However it is not clear if the wrong doings of Amway are directly related to malpractices using the services provided by Sify Technologies. This is not the first case of intermediary liability in India.

    Although the nature of the case was different, earlier in November 2012, Internet Service Providers were also held liable for copyright infringement on the internet by the Madras High Court. In this case, the court had ruled that the submission made by ISPs that they cannot prevent “future wrongs” of piracy of content is not correct, and their apprehensions about the inability to “enforce or implement the order of this court are unfounded. The court found the contention that websites host both infringing as well as non infringing content “unmeritorious”.

    It is also worth noting that the Information Technology Act 2008 has amended the definition of intermediary liability by including the Telecom service providers, internet service providers, web-hosting service providers, search engines, online-payment sites, online auction sites, online market places and cyber cafes as reported by Mondaq

    EOW Mumbai Registered FIR Against 17 People Associated with MMM India, A Scam Of 2000 Crores

    Mumbai: The Economic Offence Wing of Mumbai finally registered an FIR against 17 key people associated with MMM India. EOW said that MMM India scam could be of 2000 crores. A per their rough Idea, more than 70000 people are associated with MMM India all across India.

    After a four-month-long probe, The EOW registered a case on Monday. The FIR has names more than 17 individuals, featuring 5 foreigners, as accused. While the immigrants, all Russian nationals, include marketers Sergey Mavrodi, Alexei Muratov, Michel Glukhov and Kilin Adery, the various other accused are Indian nationals.

    In May, the Assam police had actually arrested Muratov, Adery and their 3 Indian. The EOW has also got warrant for their arrest. A  team of EOW is likely to leave for Assam on Tuesday. Look-out notifications as well have been released at all airports around India.

    The EOW mentioned in the FIR, “Ponzi plan had been drafted on the website www.mmmindia.in. While checking the site, we found that this  firm is not registered at ROC Mumbai or  as Non Banking Financial Company with RBI. The domain name address of the website revealed its web server is in Russia. An email has been forwarded to the supervisor to find out the specifics of the domain registrar.”.

     On the other end, MMM India has stopped all operations and people who invested money in the month of May and before are in tension.

    All who were arrested on May 28 among them three russians are on hunger strike and they have been admitted to Gauhati Medical College and Hospital (GMCH) after they went on a hunger strike in Central Jail.

    The Russians are Denis Rozkov, 43, Alexei Muratov, 35 and Andrei Kilin, 45.

    All were booked under Section 45 of Prize Chit and Money Circulation Scheme (Banning) Act, 1978, and Sections 120 B, 406 and 420 IPC.
