    Modicare, Amway, DXN and K-Link are cutting down their operations in Kerala

    Companies such as ModicareAmway, DXN and K-Link have finally decided to decrease their presence at Kerala. One the biggest reason for doing so is due to authorities continuous harassment faced by their distributors and company officials.  A lot has changed after the arrest of Amway India Chairman and CEO William Pinckney.

    Authorities of the IDSA, which represents all the top direct sellers in the India, said distributors of many these business are being questioned by the state police at routine periods.

    “In case the situation does not improve for the operational feasibility aspects, few of them may consider to stop operating in the state of Kerala,” Chavi Hemanth, secretary-general at the IDSA.

    She also said,”The Indian Direct Selling Association is trying their level best to convince the government to provide a safe environment, where direct selling distributors can perform their regular business activities without getting harassed by the authorities”.

    According to Indian Direct Selling Association, the 4 southern states contributed 39 per cent to the Rs 6,385-crore direct selling industry in 2011-12, and some companies get up to 40 per cent of their profits from Kerala.

    Right now in India there is no specific law to control the direct selling industry and most Direct Sellers fear that.

    The biggest shock came when the Kerala police arrested and booked Amway India Chairman and CEO William S Pinckney and 2 business directors under Prize Chits and Money Circulation Schemes (Banning) Act.

    Earlier this year, American direct selling cosmetics firm Mary Kay completely stopped their operations in India citing lack of policy and law.

    A Modicare speaker stated the home-grown direct seller is dealing with business difficulties in Kerala due to unclear steps taken by different authorities. “A clear direction from the central Government on this front is much-needed for the growth of direct selling market.

    Amarnath Sen Gupta, IDSA chairman and Indian head of Malaysian direct seller DXN, stated the organization is constantly working out with the Kerala government, adding that the decision to continue operations in the state will depend upon exactly what regulation the government introduces. Companies that had active business in Kerala include Amway, Modicare, Tupperware, K-Link, DXN and Hindustan Unilever.

    Amway India, direct selling FMCG company,  prepares to operationalise its brand-new production facility at Nilakottai in Tamil Nadu by 2015.

    The building at the site has already begun and the industrial operation at the center is most likely to commence by mid-2015,” said Diptarag Bhattacharjee, vice-president, east, Amway India.

    Total investment in around Rs 500 crore to start the plant & the same will cover 49 acres of land.

    Amway India, which is currently providing 142 items in five classifications of personal care, house care, nutrition & health, cosmetics and high value products, and at the same time they are procuring some of the items through third-party agreement producers.

    Amway India intends to take its net sales income in India to about Rs 6,000 crore by 2020.

    Last year, the business clocked a turnover of Rs 2,288 crore in the India, compared to Rs 2,130 crore in 2011.

    It eyes a development rate of five percent in 2013 compared to seven per cent in 2012.

    Amway India made a turnover of Rs 2288 crore for the fiscal year 2012 with growth of over 20 %.

    In 2012 Amway did Rs 100 crore business from Gujarat, against Rs 85 crore in 2011 and Rs 67 crore in 2010.

    Sandeep Prakash, Associate Vice Head of state, Amway India West stated, “The double-digit growth for the last 5 years is buoyed by the launch of products in health and beauty, penetration of items in semi urban and rural markets of the state and the remarkable effort put by the suppliers.”.

    Currently Amway has 135 offices pan-India out of that, 50 % of Amway offices are in villages and cities. Amway is rising and getting optimistic results in the states of Gujarat, Maharashtra, West Bengal, Karnataka, Delhi & UP.

    It is expected that Amway’s first new Tamil Nadu facility to commence manufacturing by mid-2015 and the same would  cut its dependency on imports for premium Artistry brand of products. Currently India contributed total 5 % of company volumes in 2012, where as China provided near 35 %.

    Amway’s India Chairman and CEO William S. Pinckney (right), Managing Director of Amway India, Anshu Budhraja were arrested on Monday by the The Crime Branch-Crime Investigation Department (Economic Offences Wing) along with two supervisors of the Amway company on their alleged role in facilitating  financial abnormalities.

    Though a local court on Tuesday granted conditional bail to Multi Level Marketing company Amway’s India Chairman and CEO William S Pinckney and two company Directors who were remanded to 14 days judicial custody.

    A team of officials, led by Superintendent of Police P. A. Valsan jailed Mr. Pinckney, a UNITED STATE resident, and Amway India directors Sanjay Malhotra and Anshu Budhraja in connection with a fraud cases registered in Wayanad district.

    All of them were booked under the Prize Chits and Money Circulation Schemes (Banning) Act

    All the implicated had obtained anticipatory bail from the Kerala High Court in an earlier situation registered on a problem claimed by K. Vishalakshi of Kozhikode. But now they were jailed based on complaints submitted by Jaffer and Ashraf from Rippon and Hariharan from Vaduvanchal, Ambalavayal in 2011, authorities resources claimed.

    They were summoned for questioning in connection with the instances and later on apprehended. Meanwhile, the business, in a news release, stated, “Amway has actually submitted all info and documents that have been asked for by the authorities officials. We are working together with the police for any type of additional examination.”.

    During the investigation, the investigation officers come to know that the company was making it mandatory for distributors to purchase Amway products at high rates & this amounted to violation of guidelines in Kerala.

    The police are working on leads that lakhs of rupees collected this way have been invested in the insurance business.
